The Work Number still wins the files it holds, in seconds. Equifax lists more than 5.06 million contributing employers and 839 million-plus employee records on theworknumber.com, read 2026-10-10. When a named third-party platform was used, 73 percent of the time it was The Work Number.

Those leftover calls are the job you outsource. A diner that already came back “no record found” is leftover. An ADP contributor that hit is not. What you send, and what you keep

The CRA that issues the consumer report still follows 15 U.S.C. § 1681e(b): reasonable procedures to assure maximum possible accuracy. A fulfillment vendor can place the leftover call. It does not take that duty. Each order still needs the applicant’s signed authorization and a permissible purpose under 15 U.S.C. § 1681b before outreach starts. Rules vary. Check counsel.   • Signed authorization and permissible purpose. Outreach with no auth on the file is not leftover chase.

  • The client’s SOP. Attempt count, what counts as an attempt, the fields to collect (employed, title, dates, income when disclosed), and when to close as unable to verify.

Keep the lookup, the consumer report, and the dispute path. Keep any employer the floor already has a book on if that specialist is faster than a vendor who has never called that diner.

Tell the vendor to find the number independently. Superunit’s calling-HR guide, citing Clarifacts, wants the listed main, the employer site, or a directory, with the source written on the attempt log. The number the applicant typed is a lead. It is the number a roommate can answer as HR. Business lines are the default. Cell phones are not dialed without prior consent.

What has to come back on the order

The file can leave the vendor in two states.

Verified. Employed as of the call, title in the employer’s wording, dates, and income when the employer will disclose it. Superunit’s 2026 report says 1 in 10 submitted titles is one the employer will not confirm, and 1 in 4 date pairs is off by six months or more. Post the employer’s wording. Store the recording, the transcript, and the attempt log on the order. Recording consent is a separate statute from the applicant’s FCRA authorization. Is it legal to record employment verification calls in two-party consent states? An AI voice on that leftover call is a separate telephony rule. Can a background check company use an AI voice agent to call employers?

Documented non-response. Who was called, when, the phone tree, emails, faxes, and the recording of every live conversation, time-stamped through the client’s SOP. Employers are not required to answer a private verifier. Experian Employer Services, dated October 3, 2023, read 2026-10-10, says a request from an employer, landlord, or mortgage lender is not one the law forces a private employer to return; government-agency requests are the usual exception. A refusal or a silent line is a valid close when the attempts are logged. An applicant W-2 is documentary proof. Do not relabel it as employer-confirmed VOE.
